DMCA Policy

Overview

PromptVault respects the intellectual property rights of others and expects users of our Service to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement that are reported to our designated copyright agent.

If you believe that content available on PromptVault infringes your copyright, please follow the procedure outlined below to submit a DMCA takedown notice.

1. Filing a DMCA Takedown Notice

To file a valid DMCA takedown notice, your notification must be a written communication that includes all of the following elements:

1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
2. Identification of the copyrighted work claimed to have been infringed. If multiple works are covered by a single notification, you may provide a representative list.
3. Identification of the material claimed to be infringing or to be the subject of infringing activity — including the specific URL(s) on PromptVault where the infringing material can be found.
4. Your contact information: name, address, telephone number, and email address.
5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
6. A statement made under penalty of perjury that the information in the notification is accurate, and that you are the copyright owner or are authorized to act on behalf of the copyright owner.

2. Where to Submit

Send your completed DMCA notice to our designated copyright agent using one of the following methods:

For fastest processing, please email your notice. We aim to acknowledge all valid DMCA notices within 3 business days and take action on confirmed infringements within 10 business days.

3. Counter-Notification Procedure

If you believe that content removed from PromptVault in response to a DMCA notice does not infringe any copyright, or that you have authorization to post the content, you may submit a counter-notification. A valid counter-notification must include:

1. Your physical or electronic signature.
2. Identification of the material that was removed and its location before removal.
3. A statement under penalty of perjury that you have a good-faith belief that the material was removed as a result of mistake or misidentification.
4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located.

Upon receipt of a valid counter-notification, we will forward a copy to the original complainant and may restore the removed content within 10-14 business days, unless the copyright owner initiates legal action.

4. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, PromptVault maintains a policy of terminating access for users who are determined to be repeat infringers. We will also disable access for users who have been found to submit content that infringes third-party copyright on multiple occasions.

5. Fair Use Notice

PromptVault may make use of copyrighted material without specific authorization in some cases. This may include quotation for commentary, criticism, education, and news reporting purposes — activities protected under the doctrine of fair use (17 U.S.C. § 107). If you believe content on our site that constitutes fair use has been improperly flagged in a takedown request, please contact us so we can evaluate the situation.

6. Good Faith

We take all DMCA notices seriously and act on them in good faith. However, filing a DMCA notice with false or misleading information is a violation of federal law and may expose the complainant to legal liability. We reserve the right to seek damages from parties who abuse the DMCA process in bad faith.
